Justice PV Kunhikrishnan, who presided over the case, argued that mushrooms, including magic mushrooms, cannot be considered narcotics or psychotropic substances. Magic mushrooms are at the center of this legal storm due to their psilocybin content, a substance known for its hallucinogenic effects. The petitioner, Dhanaraj, was arrested under Sections 8 (c), 22 (C), and 20 (b) (ii) (A) of the NDPS Act for possessing a quantity of these mushrooms allegedly exceeding the threshold for commercial quantity.
